TERMS AND CONDITIONS

Property Preparation: The client is expected to have the property cleaned and staged prior to the photo shoot. If the property is not ready to be photographed you should make every effort to reschedule not less than 24 hours prior to the scheduled shoot. The Drone FX is not responsible for staging, cleaning, decluttering, landscaping, or otherwise preparing the property for photos. A preparation fee may be added if any of these services are requested at the time of the shoot. It is at the sole discretion of the photographer whether to provide such services.

Access: The client is solely responsible for ensuring that the photographer has all necessary access to complete the shoot at the scheduled date and time.

Cancellation And Rescheduling: By scheduling service you affirm that the property is ready for photos to be taken. If the photographer is unable to complete the shoot, within 12 hours prior to the scheduled time, due to nonperformance or cancellation notice of the client, a $75 rescheduling fee will be applied, along with additional travel fees, if applicable. Nonperformance of the client includes, but is not limited to, the property not being prepared for photos or inability of the photographer to access the property because contact is not present or access arrangements (e.g., key in lockbox, security clearance) are not fulfilled. Rescheduling and travel fees will also apply to partially completed shoots that require an additional site visit to complete for the same reasons. We ask that if you must reschedule a shoot to do it at least 24 hours in advance.

Rescheduling Due To Weather: The Drone FX reserves the right to reschedule due to weather. Rescheduling due to weather is at the sole discretion of The Drone FX.

Aerial Photography: Shoots that include aerial photography are subject to weather and FAA flight restrictions. The Drone FX will advise the client if it is necessary to reschedule or reconfigure a shoot due to special considerations regarding aerial photography.

Quality Commitment: The Drone FX makes every effort to deliver high quality images and video to our clients. Our online portfolios are generally representative of the style and quality of our product. We ask that you review these portfolios and determine whether The Drone FX style and quality will meet your needs before placing your order. If a client feels that a delivered product does not meet these standards, we will work with them to meet their expectation. The Drone FX will perform a reasonable amount of post delivery editing on a limited number of images and/or limited video edits. Editing beyond these limits is billable at $75/hour, billed in half hour increments with a one hour minimum. If a client wants specific shots, we ask that you make a detailed request by email at least 24 hours prior to the scheduled shoot. This will enable the photographer to prepare the necessary equipment, charge batteries, etc, that may be required for the shots. If a client has special requirements, we ask that you discuss your requirements with The Drone FX prior to scheduling service.

Delivery Of Photos And Video: For most shoots, photos and video will be available online for download two business days after the client makes their photo selections for professional editing. Photos and video will remain available for download for a minimum of 30 days. In the event a client needs a photo that is no longer available online, The Drone FX can usually retrieve media from our archives on request. A $25 retrieval fee will apply.

Indemnity: The Client shall indemnify the Photographer and Representative against any claims and damages, including reasonable counsel fees, arising from the Client’s use of the photographs and the Photographer’s or Representative’s use of material or instructions of the Client.

Payment: Payment is due upon completion of the shoot. Full payment is required prior to delivery of the final images and video. The Drone FX delivers invoices by email and offers secure online payment by credit card or check. Payments over 30 days past due are subject to finance charges. Other payment options may be available on request. We ask that you inform The Drone FX in advance of the shoot if you need a purchase order.

By hiring The Drone FX to provide photographic services, you are agreeing to be bound by these terms and conditions. You are also acknowledging that such agreement constitutes a binding contract between you and The Drone FX.

The Drone FX, LLC reserves the right to change the above terms at any time without notice.
